Personal Injury

Accidents can happen at any time and anywhere – in the workplace, at home, in the supermarket, on the road, or generally when out and about.

You may be feeling unsure as to whether you have a claim. If you have been involved in a road accident you may have doubts over who is to blame, or perhaps you have suffered a personal injury at work and feel anxious about claiming against your employers.

Ewart Price has maintained a dedicated personal injury litigation department in Welwyn Garden City, Hertfordshire, for over 20 years. During that period we have recovered compensation for more than 10,000 claimants.

Zoe is an Accredited Member of the Association of Personal Injury Lawyers, so you have a wealth of experience and expertise to call upon.

If you have been injured in an accident that occurred within the last 3 years and for which you were not to  blame simply pick up the phone, send us an email or complete the “contact us” form. We will then contact you and advise you, without charge, on whether you may have a claim and, if so, will be pleased to help you through the process.

Many people are concerned about contacting a Solicitor because they are worried that there will always be a fee charged, irrespective of whether their claim is successful or not. This is not the case. If you do not have before the event legal expense insurance we will usually be able to act for  you under a Conditional Fee Agreement, commonly known as a “No-Win, No-Fee” Agreement, under which we will not charge you for any work carried out if your claim is unsuccessful. If your claim is successful the majority of our costs will be payable by your opponent.  In addition, many accident claims are now subject to fixed costs, depending on the type and value of the claim.

We are happy to discuss funding options with you during our initial consultation.

Many insurers make direct approaches to victims of accidents with low early offers of compensation in an attempt to settle a claim as quickly and cheaply as possible. If it important that you obtain independent legal advice by instructing a Solicitor and are not tempted to accept an offer before the full effect of an injury is known. It is important that expert medical evidence is obtained to ascertain the exact extent of an injury. We will ensure that appropriate medical evidence is obtained to support your claim.

It is recognised that early treatment such as physiotherapy can have a significant effect on a person’s recovery from their injury and that in cases where there has been a psychological injury, counselling such as CBT (cognitive behavioural therapy) can be remarkably effective. In appropriate cases we are able to arrange such treatment privately, at no cost to you, to avoid the usual wait for such treatment on the NHS and to give you the best chance of recovering from you injury and returning to your pre-accident activities as quickly as possible.

Personal injury has undergone drastic changes over the years, fuelled by the incorrect perception of a “compensation culture”.  Victims of accidents are often made to feel guilty for claiming what they are legally entitled to. The Government has stated its intention to withdraw the entitlement to compensation for pain and suffering for minor whiplash injuries and increase the Small Claims Court limit to £5,000 for personal injury claims. The exact details of the proposals have not yet been announced but if they go ahead it will mean that many accident victims will lose their right to claim compensation and in other cases will be unrepresented unless they can afford to pay a Solicitor. It is therefore important that if you think you have a claim and could be affected by the changes that you act quickly before the proposals come into effect.
