Many people are concerned about contacting a Solicitor because they are worried that there will always be a fee charged, irrespective of whether their claim is successful or not. This is not the case. If you do not have before the event legal expense insurance we will usually be able to act for you under a Conditional Fee Agreement, commonly known as a “No-Win, No-Fee” Agreement, under which we will not charge you for any work carried out if your claim is unsuccessful. It is recognised that early treatment such as physiotherapy can have a significant effect on a person’s recovery from their injury and that in cases where there has been a psychological injury, counselling such as CBT (cognitive behavioural therapy) can be remarkably effective. In appropriate cases we are able to arrange such treatment privately, at no cost to you, to avoid the usual wait for such treatment on the NHS and to give you the best chance of recovering from you injury and returning to your pre-accident activities as quickly as possible.
Personal injury has undergone drastic changes over the years, fuelled by the incorrect perception of a “compensation culture”. Victims of accidents are often made to feel guilty for claiming what they are legally entitled to. The Government has stated its intention to withdraw the entitlement to compensation for pain and suffering for minor whiplash injuries and increase the Small Claims Court limit to £5,000 for personal injury claims. The exact details of the proposals have not yet been announced but if they go ahead it will mean that many accident victims will lose their right to claim compensation and in other cases will be unrepresented unless they can afford to pay a Solicitor. It is therefore important that if you think you have a claim and could be affected by the changes that you act quickly before the proposals come into effect.
