Lasting and Enduring Powers of Attorney

Preparing a Single Lasting Power of Attorney £400 plus VAT.

Preparing both Finance and Health and Care Lasting Powers of Attorney £600 plus VAT.

Preparing both Finance and Health and Care Lasting Powers of Attorney for a Couple (partner, spouse or civil partner) £1,000 plus VAT.

Registration fee per document £82.

Registering an Enduring Power of Attorney £400 plus VAT.

Registration fee £82.

Obtaining a Deputyship from the Court of Protection from £950 plus VAT.

Plus court fee £400.

 

Probate

We can help you through this difficult process by obtaining the Grant of Probate on your behalf.

Inheritance Tax liability is dependent on the size of the estate. We are happy to advise clients on the likely liability prior to instruction.

Obtaining a Grant of Probate or Letters of Administration where Full Inheritance Tax Return not required from £900 plus VAT.

Plus court fee £288.

Obtaining Grant of Probate where Full IHT Return required £1,950 plus VAT.

Plus court fee £288.

Administering an Estate:- £300 per hour (partner), £200 per hour (solicitor).

Preparing a Post-Death Deed of Variation from £500 plus VAT.

Severing a Joint Tenancy £150 plus VAT.

Home visits (at our discretion) from £50 plus VAT (registered disabled).

Preparing a Declaration of Trust from £350 plus VAT.

Creation of Lifetime Trusts quote given on application.

Disbursements:

Probate court fee of £288.

Anti-money laundering ID check £20 (+VAT) per Executor.

Potential Additional Disbursements:

Certainty Will Search £105 (+VAT).

Financial Assets Search £185 (+VAT).

Bankruptcy only:

Land Charges Department searches (£2 per beneficiary).

Post in The London Gazette and Post in a Local Newspaper – Protects against unexpected claims from unknown creditors approx. £200.

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

As part of our fixed fee we will:

  • Provide you with a dedicated and experienced probate solicitor to work on your matter
  • Identify the legally appointed executors or administrators and beneficiaries
  • Accurately identify the type of Probate application you will require
  • Obtain the relevant documents required to make the application
  • Complete the Probate Application and the relevant HMRC forms
  • Draft a legal oath for you to swear
  • Make the application to the Probate Court on your behalf
  • Obtain the Probate and securely send two copies to you

Typically, obtaining the grant of probate takes 6-8 weeks.

Administration of an Estate

Administration of an Estate is conducted when a Grant of Representation has been obtained and involves collecting all assets and then distributing those assets to the appropriate beneficiaries.

We anticipate this will take between 5 and 15 hours work at £200 plus VAT per hour. Total costs estimated at £3,000 +VAT.

The exact cost will depend on the individual circumstances of the matter. For example, if there is one beneficiary and no property, costs will be at the lower end of the range. If there are multiple beneficiaries, a property and multiple bank accounts, costs will be at the higher end.

Potential additional costs

If there is no will or the estate consists of any share holdings (stocks and bonds) there is likely to be additional costs that could range significantly depending on the estate and how it is to be dealt with. We can give you a more accurate quote once we have more information.

Dealing with the sale or transfer of any property in the estate is not included.

We will handle the full process for you. This quote is for estates where:

  • There is a valid will
  • There is no more than one property
  • There are no more than 5 bank or building society accounts
  • There are no other intangible assets
  • There are 2-8 beneficiaries
  • There are no disputes between beneficiaries on division of assets. If disputes arise this is likely to lead to an increase in costs
  • There is no inheritance tax payable and the executors do not need to submit a full account to HMRC
  • There are no claims made against the estate

How long will this take?

On average, estates that fall within this range are dealt with within 3-6 months. Collecting assets can take between 6-12 weeks.

Once this has been done, we can distribute the assets, which normally takes 2-4 weeks.
